Overview

Papatriantafyllou & Thanasenari advises and represents creditors and debtors on debt collection and enforcement in Greece. Based in Athens, we act for Greek and international businesses and private clients at every stage, from pre-action demands and payment orders through to seizures and auctions, both in and out of court.

For international businesses and private clients, whether operating in Greece or based abroad, the effective recovery of a claim depends on Greek procedural rules, strict deadlines and the enforcement regime. We provide clear, practical advice on the available options and the prospects of recovery, and pursue the strategy best suited to the client’s objectives and financial position.

Debt Recovery

We act for creditors, including international businesses operating in Greece, foreign suppliers and lenders, and private clients, in the recovery of unpaid invoices, contractual debts and other outstanding claims. Our work spans formal letters of demand, payment order applications, actions for payment and the enforcement of judgments and other enforceable titles.

We assess whether the claim and supporting documents meet the requirements for a Greek payment order, a fast-track procedure that can lead to an enforceable title without a full hearing. Depending on the case, we apply for a payment order or pursue the claim through ordinary court proceedings. We pursue enforcement against assets in Greece, including seizures and auctions, and assist with the recognition, where required, and enforcement of foreign judgments.

Enforcement Defence

We act for businesses and private clients facing enforcement proceedings, including those arising from bank loans and other financial obligations. We scrutinise the legal basis of each enforcement measure and, where grounds exist, challenge it through objections and applications for the suspension of enforcement.

Where appropriate, we negotiate settlements with creditors to protect our clients’ assets and financial position. Where wider financial difficulties arise, we work alongside our Restructuring & Insolvency practice.
