The study presents the issue of legitimation for representation in support of the prosecution and who is entitled to sue for offences against offshore companies.
The study focuses on the issue of legitimation for representation in support of the prosecution and the plaintiff’s right to file charges for crimes against offshore companies. Initially, it presents the position of case law and a portion of the theory on the aforementioned matter, according to which these rights belong to the partner of the company. Subsequently, an alternative perspective is formulated, suggesting that the answer to the above issue cannot be unified but should be judged in concreto. Specifically, it should be examined whether the company has acquired legal personality under the substantive system.
