The commented decision examines interesting issues regarding the provisions of Articles 3, 4, 8, and 10 of Directive 2016/680 (the so-called Law Enforcement Directive – LED) concerning the role of the competent authorities in determining the “strict necessity” of the systematic collection of biometric and genetic data for the commission of an ex officio prosecutable offense, for the purpose of their recording.
