Restructuring & Insolvency
Overview
Papatriantafyllou & Thanasenari advises and represents businesses, creditors and private clients on restructuring and insolvency matters in Greece. Based in Athens, we act for Greek and international clients from the first signs of financial difficulty through to formal restructuring, rehabilitation and bankruptcy proceedings.
Financial distress calls for early, informed decisions. We combine rigorous legal analysis with a realistic assessment of the business and financial position, so that clients can identify viable solutions quickly and protect their interests at every stage.
Rehabilitation & Insolvency Proceedings
We act for debtors and creditors in complex restructuring and insolvency matters involving businesses and private clients, both in and out of court. Our work covers rehabilitation proceedings, through which a business in financial difficulty can reach an agreement with its creditors and have it ratified by the court, as well as bankruptcy proceedings under the Greek insolvency framework.
For debtors, we advise on the available options and represent them throughout the process, with a view to preserving the business or its value. For creditors, including international creditors of Greek companies, we act to protect and enforce their claims and their position in the proceedings.
Out-of-Court Debt Settlement
We advise businesses and private clients on Greece’s out-of-court debt settlement mechanism, covering debts to financial institutions, the Greek State and social security institutions. Our work includes assessing eligibility, preparing applications and reviewing proposed repayment terms.
We also assist with negotiations with banks and loan servicers. We assess proposed settlements against each client’s financial position and advise on their implications for assets, business operations and ongoing enforcement proceedings.
